Active DOJ/FTC Lawsuit

In June 2024, the Department of Justice and FTC filed an amended complaint against Zealthy Inc., its affiliated entities (Gronk Inc., Bruno Health P.A.), founder Kyle Robertson, and executive German Echeverry. The lawsuit alleges violations of the Restore Online Shoppers’ Confidence Act (ROSCA) and the FTC Act. Specifically: failing to disclose subscription terms before collecting billing info, failing to get consent before charging, and failing to provide a simple cancellation process.

Founded by Former Cerebral CEO

Kyle Robertson previously founded and led Cerebral, the mental health startup that faced its own DEA investigation and controlled substance prescribing controversies. This track record is relevant context.

Billing and Cancellation Complaints

The Trustpilot and BBB profiles are filled with reports of unauthorized recurring charges after cancellation. Multiple users report charges appearing under different company names (including “ZFit”), making it difficult to identify and dispute. Some users report being charged for months after cancelling.

In the SURMOUNT-5 trial, tirzepatide produced 20.2% weight loss versus 13.7% for semaglutide over 72 weeks (NEJM, 2025). At $216/mo for tirzepatide, Zealthy is one of the cheaper paths to the more effective molecule.

Multi-Category Platform

Beyond weight loss, Zealthy offers mental health, birth control, skincare, ED, and hair loss prescriptions. If it were not for the legal issues, the breadth would be a selling point.
